Article
54: The
members of the Constitutional Council shall have the duty to preserve
secrecy and shall not adopt any public position concerning the deliberations
of the Constitutional Council.
Article 55: If a member of the Constitutional Council does not no longer satisfy the conditions required for the exercice of his missions or commits a serious misdeed, the Constitutional Council shall meet in the presence of all its members. Article 56: At the end of the deliberation, the Constitutional Council shall unanimously decide on the case of the member concerned without his presence. If the member concerned is found guilty of a serious misdeed, he shall be invited to tender his resignation. The Constitutional Council shall notify the authority concerned to proceed to the substitution of the said member in accordance with the provisions of Art. 57 below. Article 57: The death, resignation or permanent impediment of one of the members of the Constitutional Council shall be followed by a deliberation of the Council. A copy of the deliberation shall be notified to the President of the Republic and, as the case may be, to the Speaker of the National People’s Assembly, to the President of the Council of Nation, to the President of the Supreme Court, or to the President of the Council of State. Article 58: Any newly appointed or elected member shall take office at the latest one full day following the normal expiration of the mandate of his predecessor in accordance with the provisions of Art. 164 of the Constitution. In this context, the renewal or replacement shall be made within fifteen (15) days before the expiration of the mandate or within fifteen (15) days following the notification referred to in Art. 57 above. Article 59: The provisions of the modified and complemented regulations setting the functioning rules of the Constitutional Council of Muharram 5, 1410, corresponding to August 7, 1989, are hereby abrogated. Article 60: This regulation shall be published in the Official Gazette of the People’s Democratic Republic of Algeria. Done
