THE PEOPLE’S DEMOCRATIC REPUBLIC OF ALGERIA

REGULATION SETTING THE FUNCTIONING RULES OF THE CONSTITUTIONAL COUNCIL

( adopted on June 28, 2000 and published in the official gazette of the Republic of Algeria, number 48 of August 6, 2000 )

 ( NB : this Regulation abrogates and substitutes the modified and complemented Regulation dated Moharam 5, 1410 corresponding to august 7, 1989 setting the functioning procedures of the Constitutional Council ).

The Constitutional Council, 

- In view of the provisions of the second paragraph of Art. 167 of the Constitution;
- In view of the modified and complemented regulation of Muharram 5, 1410 corresponding to August 7, 1989 setting the functioning procedures of the Constitutional Council;
- In view of Ordinance n°97-07 of Shawwal 27, 1417, corresponding to 6 March 1997 bearing the organic law relating to the electoral system;
- In view of Presidential Decree n° 89-143 of Muharram 5, 1410 corresponding to August 7, 1989 relating to the organizational regulations of the Constitutional Council and the status of some of its staff;

 following deliberation, adopts the following regulation setting the functioning rules of the Constitutional Council  :

TITLE I   THE FUNCTIONING RULES OF THE CONSTITUTIONAL COUNCIL ON THE CONTROL OF CONFORMITY AND CONSTITUTIONALITY

TITLE II  CONTROL OF THE REGULARITY OF  ELECTIONS AND REFERENDUMS

TITLE III   AUTHORITY OF THE OPINIONS AND DECISIONS OF THE CONSTITUTIONAL COUNCIL

TITLE IV CONSULTATION OF THE CONSTITUTIONAL COUNCIL  IN SPECIAL CASES

TITLE V  RULES RELATING TO THE MEMBERS OF THE CONSTITUTIONAL COUNCIL
