Title IV: RULES RELATIVE TO MEMBERS OF  THE CONSTITUTIONAL COUNCIL

Article 46 - Members of the Constitutional Council shall adopt an attitude of reserve and shall refrain from adopting any public position .

Article 47 - When a member of the Constitutional Council does not  meet any  longer the conditions required for the exercise of his missions or has failed to fulfil his obligations, the Constitutional Council meets in the presence of all its members  (2).

Article 48 - At the end of the deliberation, the Constitutional Council rules unanimously without the presence of the member concerned.

If such a member has committed a serious breach, the Constitutional Council shall invite him to resign and shall notify the competent authority to proceed to his replacement in implementation of the provisions of article 49 here-under  (2).

Article 49 - Death, resignation or any lasting impediment of a member of the constitutional Council shall be followed by a deliberation of the Council, of which notification shall be made to the President of the Republic as the case may be to the President of the People’s National Assembly, to the President of the Nation’s Council, to the President of the Supreme court or to the President of the State’s Council  (1).

Article 50 - In compliance with the provisions of article 164 of the Constitution, every newly appointed or elected member shall discharge his function at the latest on a clear day according to the normal date of expiry of the term of office of his predecessor.

In this connexion, renewal or replacement are carried out within the fifteen days preceding the expiry of the term of office or within fifteen days following the notification referred to in article 49 above  (2).

Article 51 - The Constitutional Council, after deliberation may authorize one of its members to participate in cultural or scientific activities when they are not liable to affect its independence or impartiality.

Article 52 - The present rule shall be published in the Journal Officiel of the People’s Democratic Repubic of Algeria  (*).
