CHAPTER 5: CONTROL

Art. 183 – The control function shall be an essential element of the revolutionary process. It shall be part of the coherent organization that characterizes the socialist State. Control shall be performed within an organized framework and shall be accompanied by sanctions.

Art. 184 – The purpose of control shall be to ensure the proper functioning of the State organs in keeping with the national Charter, the Constitution, and the laws of the country.

The aim of control is to verify the conditions of utilization and management of human and material means by the administrative and economic organisms of the State, to prevent insufficiencies, deficiencies, and deviations, to allow the suppression of corruption, embezzlements, and all criminal offences that are detrimental to the national patrimony, and to guarantee by so doing a good governance of the country in good order, clarity, and rationality.

Control shall also have the function of verification of the conformity of administrative acts with the State legislation and directives.

Art. 185 – Control shall be performed by appropriate national institutions and permanent State organs.

In its popular dimension, and to meet the requirements of the socialist democracy, it shall be exercised through elected institutions at all levels: the National People’s Assembly, the Wilaya People’s Assemblies, the Communal People’s Assemblies, and Workers Assemblies.  

Art. 186 – Political control vested in the leading organs of the Party and the State shall be exercised in accordance with the national Charter and the provisions of the Constitution.

Other forms of control, at all levels and in all sectors, shall be exercised in conformity with the provisions of the Constitution and the law.

Art. 187At the end of each financial year, the Government shall report to the National People’s Assembly on the use of budget credits voted for such financial year.

The same financial year shall be closed as concerns the National People’s Assembly by the voting of a law bearing the budget settlement for the fiscal year concerned.

Art. 188 – The National People’s Assembly may, within its prerogatives and at any time, set up an investigation committee in order to inquire on any public interest affair.

The National People’s Assembly shall designate from among its deputies the members of the investigation committee.

The law shall determine the modes of functioning of such committee.

Art. 189 – The National People’s Assembly may control socialist companies of any kind whatever.  

The law shall fix the methods of functioning of control, as well as the measures that the control results may entail.

Art. 190 – There is established an Accounting Office in charge of verifying ex post facto all public expenditures of the State, the Party, elected assemblies, and socialist enterprises of any kind whatever.

The Accounting Office shall establish an annual report to be transmitted to the President of the Republic.

A law shall determine the organization and the functioning of the Accounting Office and the sanction of the investigations thereof.
